1. Binding Effect
This agreement (“Agreement”) is a binding agreement between you (“you”) and Yogesh Fitness (“Company,” “we” or “us”). By using the site at yogeshfitness.com (the ‘Site’) or any information, coaching materials, images, layout graphics, data, text, files, software, communications, or custom content related to the Site (collectively ‘Content’) or services provided in connection with the Site (the ‘Service’), you agree to abide by these Terms of Use, as the Company may amend them from time to time in its sole discretion. YOU AGREE THAT BY USING THE SERVICE YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THIS AGREEMENT.
2. Refund Policy / Cancellation
We want you to feel comfortable transacting business with Yogesh Fitness. Due to the personalized nature of our signature Transform 90 coaching programs and the immediate digital availability and structural resource allocation of our materials upon checkout, we enforce a strict baseline transaction policy. You can cancel any subsequent renewal options at any time by contacting Customer Support via email at yogeshfitness.in@gmail.com.
Transform 90 Policy: Enrollment and onboarding assets are non-refundable. After entering our premium consulting structure, our internal coaching framework and processes will be strictly tracked. If you completely implement the explicitly assigned training routines, nutritional programs, and lifestyle actions 100% as directed and still do not experience measurable physical transformation results within 30 days, a full return review may be initiated upon verification of your documented daily tracking records.
3. Privacy Policy
Company respects your privacy and permits you to control the treatment of your personal information. A complete statement of the Company’s current privacy policy can be found by clicking the Privacy Policy link located in our footer layout. Company’s Privacy Policy is expressly incorporated into this Agreement by this reference.
4. Subscription & Billing Accounts
If you purchase any ongoing coaching structures or services that are recurring or installment based, you agree to pay and authorize automatic recurring processing of the subscription fees using your saved card or validated digital payment networks until subsequently canceled by you. You understand that recurring processing allocations are non-refundable as server slots and coach availability are allocated immediately upon authorization.
5. License & Intellectual Property
Company owns all intellectual property, text, video layouts, diet methodologies, and programmatic rights in and to the Site, Content, and Service. Except as specifically allowed in this Agreement, any scraping, duplication, copying, redistribution, or publishing of any custom training guides or materials is strictly prohibited. We grant you a limited, revocable, non-transferable license to access the program for your personal self-improvement journey only.
6. Confidentiality
All specialized fitness insights, video course modules, template spreadsheets, community group chats, and nutritional frameworks disclosed within the platform are deemed Confidential Information. You agree that you are receiving this Confidential Information in total confidence, and you will not copy, reproduce, display, or share it with third parties outside of your private coaching portal without the written consent of Yogesh Fitness.
7. Prohibited Uses of the Site & Platform
You may only use our platform for lawful, targeted health purposes. Specifically, you may not: (i) deploy software scripts or harmful code designed to disrupt the platform infrastructure; (ii) access customer or profile data not explicitly allocated to you; (iii) use automated bots or scraping tools to aggregate material; or (iv) utilize unsolicited communications or spam frameworks within our community channels.
You agree that you will not make any derogatory statements, either oral or written, or otherwise disparage our company, services, employees, or coaching staff, and will take all reasonable steps to prevent others from doing so. In the event of a significant structural platform violation or community misbehavior, Company reserves the full right to cancel your coaching access instantly, block your credentials, and remove your account from our ecosystem forever without prior authorization.
8. Mobile Alerts & Notifications
When providing your contact information, you agree that your phone number is secure and will never be shared or sold to external services. You will only receive targeted programmatic alerts when new modules open, training schedules update, or live calls are announced. Standard messaging rates may apply, and you can unsubscribe at any point by responding with standard "STOP" inputs.
9. Disclaimer of Warranties & Limited Liability
YOGESH FITNESS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM. ALL ASSETS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY MAKES NO WARRANTY REGARDING SPECIFIC INHERENT TIMELINES FOR PERFORMANCE. PHYSICAL TRANSFORMATION ACCELERATION RESULTS INDIVIDUALLY VARY AND HEAVILY DEPEND ON AN INDIVIDUAL'S OWN EFFORTS, BIOLOGICAL COMPLIANCE, DISCIPLINE, AND EXECUTION LEVELS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS STAFF SHALL HAVE NO LIABILITY FOR CONSEQUENTIAL, SPECIAL, OR INDIRECT DAMAGES RESULTING FROM EXERCISE FORM IMPLEMENTATION, NUTRITIONAL SELECTION, OR PORTAL ACCESSIBILITY ISSUES.
