Consulting Service Agreement & Refund Policy

Welcome to Yogesh Fitness (hereafter “Yogesh Fitness”, “we”, “us”). This Agreement governs the relationship between the Client (hereafter “you”) and Yogesh Fitness regarding your enrollment, access to training assets, and lifestyle consulting services. Your express move of subscribing constitutes an acknowledgment that you have read, completely understood, and consent to be obliged by these terms without restrictions.
1. Platform and Coaching Services
Yogesh Fitness provides premium physical optimization systems, tailored nutritional protocols, and behavioral adjustments. Recommendations made by your coach are advisory; clients must exercise independent personal judgment regarding the physical application of training metrics and macro targets.
2. Program Deliverables & Execution Phases
As a part of the Transform 90 premium coaching track, the Client will receive access to the following structural roadmap during their active portal validity:
- Phase 1: Biological Assessment, Custom Macro Blueprint & Private Asset Vault.
- Phase 2: Kinetic Form Optimization, Strength Progression & Metabolic Tracking Setup.
- Phase 3: Advanced Physique Recomposition & Advanced Conditioning Protocol.
- Phase 4: Long-term Maintenance Strategy, Autonomic Habit Scaling & Lifestyle Integration.
Each Client receives a holistic support matrix including a recurring check-in schedule, an assigned Accountability Manager, a digital tracking dashboard, and community access via the Learning Management System (LMS) for the designated duration of the purchased program.
3. Exchange, Charges, & Payment Processing
Clients must prepay processing balances to secure a training slot. All primary online payments are safely routed via integrated, industry-standard checkout channels (such as Razorpay or Stripe digital payment gateways).
In exchange for premium structural consulting configurations, checking metrics, and personalized video track modules, the Client agrees to complete the specified financial tier fee (e.g., standard enrollment setup at ₹1,97,000/- INR inclusive of applicable statutory GST components where applicable) to open cross-platform system clearance.
4. Registration Procedures & Team Access
Slots are limited due to high-touch coach attention constraints. The following standard onboarding protocols apply:
- Registration Split: If a baseline commitment deposit is processed to lock a calendar slot, any remaining outstanding balances must be cleared within seven (7) days to confirm official batch onboarding. Failure to close balances within the designated timeframe will result in immediate slot forfeiture.
- Privity Constraints: Access credentials, tracking links, and dashboard resources are single-user metrics assigned specifically to the subscribing Client. Sharing platform links, video calls, or copying premium dashboard spreadsheets with unauthorized individuals will trigger instant profile suspension without recourse.
5. Prohibited Conduct & Community Standards
Users explicitly agree not to utilize our community portals or check-in trackers to: (i) copy, extract, or redistribute training plans or recipes; (ii) post abusive, threatening, vulgar, or indecent communications; (iii) attempt to harvest client data or contact lists; or (iv) distribute malicious software scripts or disrupt systemic cloud platform operations.
6. Defamation & Reputational Integrity
The Client agrees not to engage in any coordinated acts or public postings designed to disparage, defame, or undermine the public perception of Yogesh Fitness, its coaches, or community members. Malicious actions or libelous behavior across public or private networks will be treated as an immediate material breach, resulting in instantaneous account termination and appropriate legal protection remedies.
7. Account Deferrals & Emergency Pauses
In the event of an unavoidable emergency or medical situation that requires a temporary pause in coaching, a written request must be submitted via email within the original validity period of your course tracking timeline. Upon validation, the course may be paused and reactivated for the remaining balance period upon payment of a minimal structural administrative reactivation fee (₹2,500/- INR).
8. Refund Policy Window
Strict Limited Protection Window: Because coaching slots require immediate individual nutritional calculations, operational time allocations, and backend cloud profiling, we enforce a strict 7-day limited refund window from the initial day of enrollment transaction. Refund requests submitted outside of this 7-day period will not be reviewed or processed under any circumstances.
To maintain eligibility during an active refund verification process within the initial 7 days, the following performance metrics must be strictly verified by our automated system logs:
- The client must have fully completed and uploaded all baseline physiological assignments and onboarding sheets.
- No programmatic training plans, nutrition guides, or custom spreadsheets may have been extracted, screenshotted, or shared with external parties.
- If execution commands are delayed by the user, or if assignments are skipped, refund criteria are considered null, void, and forfeited.
9. Systemic Proprietary Confidentiality
"Confidential Information" encompasses all specialized exercise breakdowns, proprietary food metrics, lifestyle matrices, swipe trackers, custom video sheets, and elite check-in frameworks provided during the program. You agree to hold these materials in the absolute strictest confidence and completely refrain from copying, selling, modifying, or duplicating them for commercial use or public display.
